Amgive Terms and Conditions
AmGive Grant Program provides the opportunity for all Amway Independent Business Owners (IBOs) who are qualified as Platinums or above to apply for financial support of non-profit organisations.
Amway reserves the right to approve and/or reject, at Amway’s sole discretion, any submissions during the selection process to ensure each one-time AmGive donation aligns with the best interests of Amway, its brands and strategic direction. Additionally, Amway reserves the right to cancel or modify these T&Cs of the Program at any time.
AmGive submissions will be subject to a grading rubric based on the following criteria.
- Tier 1 Criteria – Must meet these criteria for eligibility.
- Tier 2 Criteria – Meeting these criteria will be ideal for selection.
- Tier 3 Criteria – Preferred but not required criteria.
Applicant disclosure
Applicants must disclose if they are a founder, co-founder, board member, officer and/or other decision-maker of the nominated non-profit organisation.
Key dates
- Start of Performance Year Application period opens for awards in current Performance Year (PY).
- April 30 Application period closes for current PY awards.
- May PY awards announced.
Tier 1 Criteria – Must meet these criteria for eligibility.
- Submissions must benefit non-profit organisations (registered and recognised by government tax agency).
- Non-profit organisations must provide (a) an official letter with a formal request for the specified amount of contribution and the purpose of it, (b) bank information, (c) annual financial report and (d) proof of non-profit registration and/or statute.
- Amway must receive a signed receipt confirmation (contribution receipt) upon donation (cash or in-kind).
- AmGive applications are open to all IBOs qualified as Platinum and above IBOs who have been active in their Amway businesses for at least two years and are in good standing.
- Amway does not support religious organisations unless they meet all the following requirements:
- a) are open to all individuals in the community regardless of religious belief;
- b) serve a secular purpose, such as a food pantry or a homeless shelter, and
- c) do not require individuals to join in religious worship to receive the services that the nonprofit offers.
Tier 2 Criteria – Meeting these criteria will be ideal for selection.
- Non-profit organisation mission aligns with Amway pillars of Health, Nutrition & Wellbeing, Empowerment, Sustainability and/or Engagement.
- Non-profit organisation and applicant will allow Amway to use its name, image, and likeness in the creation and distribution of promotional materials related to the donation and will provide assets from the calendar year in which the donation is made.
- Non-profit organisation or applicant can and/or have tracked the impact of IBOs and are willing to share this data with Amway.
- More than two IBOs are actively engaged with this non-profit organisation.
Tier 3 Criteria – Preferred but not required criteria.
- Non-profit organisation aligns with Amway brands and product portfolio.
- Amway and its employees, ABOs, or Founding Families have previously supported the non-profit organisation.
- Applicant previously supported the non-profit organisation or cause with financial or in-kind contributions or volunteerism.
Use of Data and Transfer of Copyright; IP rights clause
Participation in AmGive Grant Program constitutes each winner’s permission for Amway to use NGOs name, address (city and state), logo and/or when it relates to physical persons representing NGO: likeness, photograph, picture, portrait, voice, biographical information, entry and/or any statements made by each winner regarding AmGive Grant Program or Amway for public display and advertising and promotional purposes in any form or media now known or developed in the future without notice or additional compensation, except where prohibited by law.
Participation in AmGive Grant Program constitutes each Participants’ (IBOs) permission for Amway to use name, address (cityand state), likeness, photograph, picture, portrait, voice, biographical information, entry and/or any statements made by each Participant (including but not limited to story provided to Amway) regarding AmGive Grant Program or Amway for public display and advertising and promotional purposes in any form or media now known or developed in the future without notice or additional compensation, except where prohibited by law.
By participating in the Program Participants and/or NGOs assign to Amway any and all worldwide right, title and interest in their entries, including but not limited to any copyright (e.g. story provided to Amway) and the right to use the entry and copies and derivatives in any manner Amway chooses. By making an entry, each Participant and/or NGOs represents and agrees that the entry was originally authored and not copied from anywhere else, that the entry is not derived from any prior work and that the assignment of the rights in the entry to Amway does not violate any rights of any third party or any agreement the Participant and/or NGOs has with any third party and agrees to sign any appropriate local law documents confirming the same.
By participating, Participants and/or NGOs agree to release and hold harmless Amway and their respective advertising and promotion agencies as well as their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, “Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which AmGive Terms & Conditions may occur in connection with, preparation for, travel to, or participation in AmGive Grant Program or possession, acceptance and/or use or misuse of prize or participation in any AmGive Grant Program-related activity and for any claims based on third party rights in the entry or arising out of the use of the entry (including but not limited to the story provided to Amway) as allowed by these Terms and Conditions including but not limited to publicity rights, copyright infringement, trademark infringement or any other intellectual property-related cause of action.
Participants and/or NGOs, who do not comply with these Terms and Conditions, shall be disqualified. Amway shall not be held liable if AmGive Grant Program cannot take place or if any prize cannot be awarded due to travel cancellations, visa denials, delays or interruptions due to Force Majure, including but not limited to acts of God, acts of war, natural disasters, legislature changes, weather or acts of terrorism or any other circumstances beyond the reasonable control of Amway.
Limitation of Liability; Disclaimer of Warranties
The Organiser of AmGive GRANT PROGRAM is, for any legal purpose, Amway of Australia and it's related body corporates.
In consideration for Amway allowing to participate in the Program, to the greatest extent permitted by law, all Participants and/or NGOs shall hereby waive all their claims or causes of action they have or may have in the future against Amway, its related companies, their affiliates, and their respective directors, officers, employees, and agents, and shall release all such entities and individuals from any and all liability for any loss, damage, expense, injury, or death that Participants and/or NGOs may suffer as a result of participation in the AmGive Grant Program. This limited liability does not apply in the event of malicious misconduct or gross negligence. Participants and/or NGos shall further indemnify all such entities and individuals against any claims of whatsoever nature that may be brought against them by any third party arising out of and/or in connection with their participation in the AmGive GRANT Program, including, but not limited to, any claims for any property damage, loss, or personal injury to any such third party.
WITHOUT LIMITING THE FOREGOING, AmGive GRANT PROGRAM AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Disputes; Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. You may bring proceedings which may arise under these Terms to, at your discretion, either to the competent court of New South Wales, Australia or to the competent court of Auckland, New Zealand, if your country of habitual residence is New Zealand. We shall bring any dispute which may arise under these Terms to the competent court of your country of habitual residence if this is in within Australia or New Zealand.
